These Terms of Service (“Terms”) govern your use of the Forward Wealth LLC website at forwardwealth.com and any related services we make available (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Forward Wealth LLC (“Forward,” “we,” “us”) is an investment adviser registered with the State of New York. Registration does not imply a particular level of skill or training.
Using the Services does not create an advisory relationship
This is the most important term in this document. Browsing the site, submitting a form, scheduling a consultation, speaking with us, or creating an account does not make you an advisory client of Forward and does not create a fiduciary, advisory, or professional relationship of any kind.
Investment advisory services are provided only to clients who have entered into a written advisory agreement with Forward Wealth LLC. That agreement, together with the disclosures we deliver with it, governs the advisory relationship. Until you sign one, nothing we provide through the Services is investment, tax, legal, or accounting advice, and nothing should be relied on as a recommendation to buy, sell, or hold any security or to adopt any strategy.
If you do become a client, the written advisory agreement controls wherever it differs from these Terms.
Who may use the Services
You must be at least 18 years old and a resident of the United States to use the Services.
Forward is registered as an investment adviser in New York and may provide advisory services in other states only where it is registered or where an exemption from registration is available. Information on the Services is not an offer to provide advisory services in any jurisdiction where we are not permitted to do so. We may decline to open or continue a relationship for any lawful reason, including where doing so would require a registration we do not hold.
Scheduling a consultation
You can use the Services to request and schedule a consultation with us. Scheduling a consultation is free and creates no obligation on either side. A consultation is a conversation about whether working together makes sense — it is not advice, and it does not begin an advisory relationship.
We may need to reschedule or cancel a consultation. Scheduling is handled through a third-party provider, and its availability is outside our control.
Your account and the information you give us
Some parts of the Services require an account. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for activity that occurs under your account. Tell us promptly at support@forwardwealth.com if you believe your account has been used without your permission.
Content you submit. You may be able to submit information, files, or other content through the Services. You keep ownership of what you submit. You give us permission to use it to operate the Services and to provide services to you, and you confirm you have the right to share it. Do not submit anything you are not permitted to share.
How we handle personal information is described in our Privacy Policy, which is part of these Terms.
Information you provide about your position
The Services may ask you for details about a concentrated stock position — the ticker, the value of the position, its cost basis, and your state of residence. You supply these figures yourself. We do not connect to your brokerage or bank accounts, and we do not receive your account login credentials.
Any estimate, projection, or comparison the Services produce from those figures is illustrative only. It rests on the numbers you enter and on general assumptions that will not match your circumstances exactly. It is not tax advice, it is not a recommendation, and it does not predict any actual result. Tax outcomes depend on facts we do not have, including your other realized gains and losses, your filing status, and changes in law. You should rely on statements from your financial institutions as the accurate record of your accounts, and consult a tax professional about your own situation.
Information on the Services is for general information only
Anything shown through the Services — including balances, totals, charts, projections, illustrations, educational material, and general information about investing, taxes, or planning — is provided for general informational purposes. It is not personalized advice and does not take your particular circumstances into account.
Projections and illustrations are hypothetical. They rest on assumptions that will not match real conditions, and actual results will differ. Past performance does not guarantee future results, and investing involves risk, including possible loss of principal.
Communications
By providing your contact information, you agree we may contact you about your inquiry. If you separately consent to receive text messages, message frequency varies, message and data rates may apply, you can reply STOP to opt out and HELP for help, and you can withdraw that consent at any time. Consent to receive text messages is not a condition of using the Services or of becoming a client.
Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms
- Access another person's account, or submit information about someone else without their permission
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or their underlying systems
- Scrape, copy, or systematically extract the Services, or use automated means to access them without our written permission
- Misrepresent your identity or your relationship with Forward
Our content
The Services and their content — including text, design, graphics, logos, and software — belong to Forward Wealth LLC or its licensors and are protected by intellectual property laws. You may use the Services for your own personal, non-commercial purposes. We keep all rights not expressly granted here.
The Services will change
We are actively building Forward. We may add, change, suspend, or remove any part of the Services at any time, and we may do so without notice. We do not promise the Services will be uninterrupted, error-free, or available at any particular time, and we may limit or discontinue access for any lawful reason.
Disclaimers
Except as expressly stated in these Terms and to the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements or that any information available through them is accurate, complete, or current.
Limitation of liability
To the fullest extent permitted by law, Forward Wealth LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Services.
Nothing in these Terms waives or limits any right or remedy you may have under the federal securities laws, the securities laws of any state, or any other law where such a waiver would not be permitted. Nothing in these Terms limits any duty, including any fiduciary duty, that Forward Wealth LLC owes to its advisory clients. Some jurisdictions do not allow certain limitations of liability, and those limitations do not apply to you to the extent prohibited.
Ending your use of the Services
You may stop using the Services at any time and may ask us to close your account by writing to support@forwardwealth.com. We may suspend or terminate access if we believe these Terms have been violated or where necessary to protect the Services or other users.
When an account is closed, we remove access to it and delete associated information, except for records we are required to keep under applicable recordkeeping laws or that we must retain for legitimate legal purposes. Our Privacy Policy describes how we handle retention. If you are an advisory client, closing an account does not by itself terminate your advisory agreement — that agreement sets out how it ends.
Governing law and where disputes are resolved
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. You and Forward Wealth LLC agree that any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in New York, and both of us consent to the jurisdiction of those courts. This does not limit any right you have to bring a claim before a regulator or in any forum that applicable law makes available to you.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a revised date, and changes take effect when posted. If you keep using the Services after that, you accept the updated Terms. If we make a material change, we will take reasonable steps to let active clients know.
General
If any provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent. These Terms, together with the Privacy Policy, are the entire agreement between you and Forward Wealth LLC regarding the Services, and do not replace any written advisory agreement you enter into with us.
